Terms of Service
1. Acceptance of Terms
By accessing or using SiliconWit.io services, including our IoT platform, websites, APIs, and documentation, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Services
SiliconWit.io provides an Internet of Things (IoT) platform for monitoring and managing connected devices, sensors, and assets. Our services include device management, real-time data collection and visualization, configurable alerts and notifications, remote device control, data export, public dashboards, and a developer API. 3. Account Registration
To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including passwords, device access tokens, and API keys. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the services, servers, or connected infrastructure
- Transmit malicious code, exploit vulnerabilities, or flood the platform with excessive data
- Exceed rate limits or circumvent usage restrictions
- Use the platform as the sole safety mechanism for life-critical or safety-critical systems without independent safeguards
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Resell, sublicense, or redistribute access to the services without our written consent
5. Device and Data Responsibility
You are responsible for ensuring that your IoT devices are properly configured and secured. This includes keeping firmware up to date, securing device credentials, and ensuring devices comply with local regulations in your jurisdiction (including radio frequency, data collection, and environmental regulations).
SiliconWit.io is not liable for damages resulting from misconfigured devices, insecure access tokens, data loss, or security breaches originating from your devices or network.
6. Data Accuracy
The platform displays data as received from your devices. We do not verify the accuracy, completeness, or reliability of sensor readings, measurements, or other telemetry data. You are responsible for validating data accuracy for your use case, especially where decisions based on the data could affect safety, health, or financial outcomes.
7. Subscription Plans and Payments
A free plan is available with limited features. Paid plans offer increased device limits, longer data retention, additional notification channels, API access, and other features. See our plan documentation for current plan details and pricing.
If a paid subscription expires without renewal, your account will be downgraded to the free plan. This may result in excess devices being paused, API keys being revoked, and data beyond the free plan's retention period being deleted after a grace period.
8. Data Ownership and Retention
You retain ownership of all data you upload or collect through our platform. We process, store, and display your data only as necessary to provide the services.
Telemetry data is retained according to your plan's retention period. Data exceeding your retention period is permanently deleted after a grace period. You will receive a warning email before automated deletions occur. See our data retention documentation for specific periods per plan.
Important: Deleted data cannot be recovered. We do not retain backups of individual user data after deletion. We strongly recommend exporting your data regularly using the CSV or Excel export feature.
9. Account and Device Deletion
You may delete devices or your entire account at any time from your dashboard. Both operations include a grace period during which you can cancel. After the grace period, all associated data is permanently removed with no possibility of recovery. See our deletion documentation for details on grace periods.
Devices on the free plan that remain inactive beyond the allowed period may be automatically paused and eventually deleted. We will send a warning email before any automated deletion. See our inactive device documentation for details.
Inactive accounts on the free plan (no devices, no login for 6+ months) and unverified accounts (30+ days without email verification) may also be automatically deleted. You will receive a warning email with a 30-day grace period before any verified account is deleted. See our inactive account cleanup documentation for details.
10. Public and Shared Data
When you make a device public, the data you select becomes accessible to anyone with the link. You are responsible for ensuring that publicly shared data does not contain sensitive, confidential, or personally identifiable information that you are not authorized to share.
When you share a device with another user, they can view the fields you grant access to. You are responsible for managing shared access and can revoke it at any time.
11. API Usage
API access is subject to rate limits and fair use policies. You must not use the API in a way that degrades service for other users or circumvents platform limits. API keys are confidential and must not be shared publicly or embedded in client-side code. We reserve the right to revoke API access for abuse or violation of these terms. 12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. The platform should not be relied upon as the sole safety mechanism for critical systems. You are responsible for implementing independent safeguards for any application where service interruption could result in harm.
13. Limitation of Liability
To the maximum extent permitted by law, SiliconWit.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the services. This includes, without limitation, damages arising from service interruptions, data loss, inaccurate sensor data, failed alert delivery, or unauthorized access resulting from compromised device credentials.
14. Indemnification
You agree to indemnify and hold harmless SiliconWit.io, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the services, violation of these terms, or your deployment of IoT devices in connection with the platform.
15. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations under these terms due to circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power failures, internet outages, or third-party service provider failures.
16. Termination
We may suspend or terminate your account for violation of these terms, abuse of the platform, or prolonged inactivity on the free plan. Upon termination, your right to use the services will cease. You will be notified before termination where possible and may export your data during any applicable grace period.
In cases of serious violations, including but not limited to unauthorized access attempts, illegal activity, underage usage, or actions that threaten the security or integrity of the platform or other users, we may terminate your account with a reduced or no grace period. We will attempt to notify you by email when such action is taken. See our account termination documentation for details.
17. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of the services after changes constitutes acceptance of the updated terms.
18. Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
